Trump Gains Authority to Revise National Monument Designations

The Justice Department has provided a significant legal opinion affirming that President Donald Trump has broad authority to revoke national monument designations made by his predecessors.

This memorandum has the potential to allow Trump to withdraw millions of acres from protected status, effectively reversing the expansive designations that have sparked considerable debate regarding their necessity and the motives behind them.

For too long, the previous administration expanded monument designations such as Bears Ears and Grand Staircase-Escalante, much to the detriment of local communities and their economic interests.

The Justice Department’s Office of Legal Counsel concluded that while presidents can designate monuments under the 1906 Antiquities Act, they also possess the authority to reduce the size of existing monuments or eliminate them altogether.

Senate Energy and Natural Resources Chairman Mike Lee, a Republican from Utah, praised this opinion, arguing it aligns with the principle that monument designations should be made with consideration for those who live in proximity to these lands.

"This new clarity from the DOJ empowers the president to reassess and improve monument designations that may be excessive or disconnected from their intended purpose," Lee remarked.

This development arrives at a time when there’s a growing recognition among lawmakers and landowners that previous administrations have often used the Antiquities Act as a political tool rather than a means for genuine environmental preservation.
