Rep. Darrell Issa (R-CA) is taking decisive action to curb what he refers to as “rogue rulings” from federal district judges with his upcoming legislation, the “No Rogue Rulings Act.”
This bill aims to limit the powers of district judges to issue nationwide injunctions, a practice that has been exploited to obstruct key presidential executive orders, particularly during Donald Trump's administration.
Issa emphasizes that the judiciary’s overreach is not what the Founding Fathers intended. The Constitution provides for a Supreme Court as the ultimate arbiter, not individual district judges commandeering national policy from their local jurisdictions.
“District courts were created by Congress to take cases from plaintiffs within their districts to alleviate the Supreme Court's docket,” Issa explained during an interview on Sirius XM’s Breitbart News Saturday.
He added that the power of nationwide injunctions has led to a situation where a single judge can effectively block national policy, disenfranchising the will of voters and their elected representatives.
This unprecedented judicial overreach has been particularly apparent during Trump's presidency, where as many as 15 nationwide injunctions were issued against his administration, reflecting a troubling pattern in which leftist groups "shop" for favorable judges to achieve their agenda.
Issa's bill is not just a Republican partisan effort; it seeks to establish a balance that, in the future, would apply equally regardless of which party holds the presidency.
While Democrats may resist the measure, Issa expressed hope that more rational members from across the aisle could recognize the long-term benefits of limiting judicial power.
Beyond the No Rogue Rulings Act, Issa outlined additional legislative initiatives that would address this issue further by defining venues for lawsuits and ensuring quicker appeals for presidential policies challenged in court.
