On Monday, former President Donald Trump announced his selection of Republican Senator JD Vance of Ohio as his running mate for the upcoming election.

The announcement was met with concern from MSNBC political analyst Susan Del Percio, who expressed her fear over Vance's potential impact on the permanent bureaucracy.

Del Percio, speaking on MSNBC, stated that what scared her about Vance was his intelligence and understanding of policy. She suggested that Vance could make fundamental changes to the administrative state that Trump may not care about.


She further claimed that Vance could go into regulatory areas that Trump may not care about, such as drilling and specific state policies, and start making policy changes at a mid-level. According to Del Percio, these changes could have a huge effect and long-term consequences.

In September 2021, Vance reportedly suggested that Trump should fire all mid-level bureaucrats in his second term. He further stated that if the courts stopped Trump, he should stand before the country and say that the Chief Justice has made his ruling, now let him enforce it.

Recent Supreme Court decisions have curtailed the powers of regulatory agencies. In June, the Supreme Court struck down the so-called "Chevron deference" in a 6-3 ruling. In a separate case involving the Securities and Exchange Commission (SEC), the court ruled that civil fines required a jury trial under the Seventh Amendment.

In 2022, the Supreme Court ruled that the Environmental Protection Agency overstepped its authority in West Virginia v. EPA.

These decisions have limited the power of regulatory agencies and could pave the way for Vance to make the changes he has suggested.

As the election approaches, it remains to be seen what impact Vance will have on the administrative state if elected as vice president. However, his selection as Trump's running mate has certainly raised concerns among some on the left.
