House Republicans Challenge Jan. 6 Committee's Legitimacy in Supreme Court

House Republicans, led by Speaker Mike Johnson, are taking a stand against the January 6th Select Committee by authorizing the House counsel to file an amicus brief supporting Steve Bannon’s emergency appeal to the Supreme Court. Johnson announced on Tuesday night that he has approved having the U.S. House intervene in Bannon’s contempt case, arguing that the Democrat-run January 6 committee was illegitimately formed and its work was compromised.

Johnson told Fox News host Sean Hannity that he has authorized the House counsel to file an amicus brief with Bannon’s appellate work, stating that the January 6 committee was wrongfully constituted and its work was tainted. He added that the committee may have covered up evidence and engaged in more nefarious activities. Johnson also mentioned that the House has been investigating the committee itself and disagrees with how Speaker Pelosi put it together, as it violated House rules.

The move by House Republicans comes in response to recent developments surrounding the prosecution of former Trump advisors Steve Bannon and Peter Navarro, both sentenced for contempt of Congress related to the committee’s investigations. Bannon argues that he shouldn’t have to serve four months in prison as sentenced because the January 6 committee abused its authority in holding him in contempt.

The last-minute appeal to the Supreme Court has taken on new significance in the debate over whether there is a dual system of justice. Earlier this month, the Biden Justice Department announced it would not prosecute Attorney General Merrick Garland even though he refused to turn over evidence to Congress as subpoenaed.

The action from Republicans is unfolding just days before Bannon is ordered to surrender himself to federal prison to serve a four-month sentence. On Monday, Jim Banks (R-IN) set the stage with a pointed letter to Speaker Mike Johnson (R-LA), expressing gratitude for supporting Loudermilk’s investigation into the committee’s conduct. Banks criticized the committee for alleged partisan biases, procedural violations, and issues with its subpoenas, highlighting discrepancies from traditional congressional norms and raising concerns over evidence destruction.

These efforts culminated in the Bipartisan Legal Advisory Group (BLAG) voting 3-2 to officially declare the Jan. 6 Committee and all its subpoenas as illegitimate, exposing a deepening partisan divide over the committee’s actions and setting the stage for a significant legal confrontation. In a move that further escalated the conflict, BLAG directed the House Office of General Counsel to file an amicus brief supporting Bannon’s appeal to the Supreme Court.

The significance of these developments extends beyond Bannon’s case, reflecting broader Republican discontent with the committee’s authority and methods left by former Speaker Nancy Pelosi (D-CA). Loudermilk hinted at forthcoming legislation nullifying the committee’s work, underscoring ongoing efforts to challenge its legitimacy in legal and legislative arenas.
